Terms of Use
Budge runs entirely on your phone. No servers, no account, no tracking. Your words, steps, and history never leave your device, so there is nothing for anyone to collect, sell, or leak. The full Privacy Policy and Terms below say this carefully and set fair, standard expectations for using the app.
Acceptance and eligibility
By downloading or using Budge, you agree to these Terms. If you do not agree, please do not use the app. You must be at least 13 years old, and old enough to form a binding contract or have a parent or guardian agree for you; purchases require the age of majority where you live.
Your license to use Budge
The maker grants you a personal, limited, non-exclusive, non-transferable, revocable license to use Budge on Apple-branded devices you own or control, for your own non-commercial use, in line with the App Store Terms of Service. This license is also governed by Apple's standard Licensed Application End User License Agreement, available from Apple. Where these Terms and that standard agreement differ, the term more protective of you applies to your use of the app.
Acceptable use
Please use Budge lawfully and kindly toward yourself. Do not copy, resell, sublicense, rent, or redistribute the app; do not reverse engineer, decompile, or attempt to extract its source except where the law expressly permits; and do not interfere with or attack the app, or use it to break the law or infringe others' rights.
Intellectual property and your content
Budge, including its design, text, and trademarks, is owned by the maker and protected by law; nothing here transfers those rights to you. Anything you create in the app is yours and stays on your device, and because the maker never receives your content, the maker claims no rights to it.
Budge+ and purchases
Everything essential in Budge is free. Budge+ is optional. If offered as an auto-renewing subscription, it renews for the same period at the then-current price until you cancel, and your account is charged through Apple. You can manage or cancel in your iPhone Settings, under your name, then Subscriptions; cancel at least 24 hours before a renewal to avoid the next charge. Refunds are handled by Apple at reportaproblem.apple.com. Prices and contents may change with notice, and never retroactively for a period already paid.
Not medical care
Budge is provided for general wellness and educational purposes only. It is not a medical device, not therapy, and not a substitute for professional care. It is not intended to diagnose, treat, cure, or prevent any condition, and nothing in the app is medical, clinical, or legal advice. Always seek the advice of a qualified professional with any question about your health or medication, and never disregard professional advice, delay seeking it, or stop or change a treatment because of anything in the app. Budge is built so that it does not give medical advice; if you ask it a medical question, it will say so and point you to a professional.
Not a crisis service
Budge cannot help in an emergency. If you may be in danger or thinking about harming yourself, contact your local emergency number now, or in the US call or text 988 (the Suicide and Crisis Lifeline). Service members and veterans can reach the Veterans and Military Crisis Line by dialing 988 and pressing 1, or texting 838255, free and confidential, and available even without VA enrollment. Budge can point you to support resources at any time, and reaching them is always free and never behind a paywall.
Disclaimers
Budge is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The maker does not warrant that the app will be uninterrupted, error-free, or suitable for your particular needs.
Limitation of liability
To the maximum extent permitted by law, the maker will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the app. To the maximum extent permitted by law, the maker's total liability for any claim relating to the app will not exceed the greater of the amount you paid for the app in the twelve months before the claim or fifty US dollars. Some places do not allow certain limitations, so parts of this may not apply to you.
Indemnification
To the extent permitted by law, you agree to indemnify and hold the maker harmless from claims and costs arising out of your misuse of the app or your violation of these Terms or of any law or third-party right.
Apple and third parties
These Terms are between you and the maker, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties. Your use of Apple's services remains subject to Apple's own terms.
Termination
You may stop using Budge at any time by deleting it, and your license ends when you do. The maker may suspend or end the license if these Terms are seriously or repeatedly violated. Sections that by their nature should survive, such as intellectual property, disclaimers, limitation of liability, and indemnification, survive termination.
Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. If you have a concern, please email Budgesupport@gmail.com first so the maker can try to resolve it informally. Disputes not resolved that way will be handled by the state or federal courts located in Florida, and you consent to that venue, except where the law gives you a non-waivable right to another forum.
Changes to these terms
The maker may update these Terms; the updated version will appear here with a new effective date, and continuing to use the app after that means you accept the change. If a change is material, it will be made clear.
General
If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with Apple's standard end-user agreement and the App Store Terms, are the entire agreement about the app. A delay in enforcing a term is not a waiver of it. You may not assign these Terms; the maker may assign them in connection with a transfer of the app.
Servicemembers and veterans
Budge is independent. It is not affiliated with, endorsed by, or sponsored by the US Department of War (the Department of Defense), the Department of Veterans Affairs, or any government agency. Budge+ carries no long-term commitment: any subscription can be cancelled anytime through Apple, with no lock-in or penalty, so protections such as the Servicemembers Civil Relief Act, which can pause or end certain financial and civil obligations during active service, have nothing here they would need to reach.
